How do I find out which side of the fence is ours? I’ve looked through all our house paperwork and boundaries etc and can’t see anything which says what side?

If you look at the front of you house the fence on the left is your responsibility. As the law stood at one time. Not sure to day people tend to share.

You need to check your deeds or speak to land registry. Dont base it on which side the fence is facing because it may not be accurate as in our case it's the neighbours boundary but he let us have the good side of the fence as we paid for it. The only way you will find out for sure is from checking the correct documents, ask the solicitor that dealt with your house purchase see if they can advise.

Yes but then the batons are on the inside which is unusual, you'd normally put your fence up so you're looking at the nice side not the back?

@auctorial That's how it should be if the fence is yours  The fence is the boundary, so the posts etc. go in the owners side ☺️

@auctorial no rules. I have battens both side but I only own 1 side and the rear. Etiquette states that you have the batten side though. (and whoever put the rear fence up did it the wrong way round - with battens to the road behind. which is really unusual)

Our deeds say as you look at the house from the front we are responsible for the fence on the left, also in our last 2 houses.

To be honest my last house I replaced all the fencing and paid for it, I had all good sides to me, just because I paid for it and they wouldn’t/ couldn’t. I also gave them the paint to paint their side

@feints yes I’m happy to get it done as it needs replacing. but he has all sorts growing up the current fence which will need to come down (probably why it’s weak on that side)

Check your deeds/land registry boundary diagram your fences will be marked with a T. You can't go by which way fences are hung as some people have them put up wrong way round.

Please don’t rely on Facebook to tell u which is your house boundary all houses are different all over the country! If u have purchased the house you will have deeds and the boundary marked with a T marked inside your garden this is the side you are responsible for, if u can’t find this speak to your solicitors and they shld either have it on file or point you in the right direction to obtain a copy. Ours is the rhs but I asked the neighbour if she minded us having the good side and she wasn’t bothered so don’t rely on that either!

@diazo don’t assume anything or it will end up costing you, I wld get in contact with the solicitors that u purchased the property with first, otherwise then speak to the neighbours but I fear you are leaving yourself wide open to costs that may not end up being yours. Good luck

@stamina thanks I’ll ask the solicitor. I’m happy to replace the fence. Our neighbours are lovely. I just didn’t want to upset them because they love gardening and have all stuff growing up the fence ‍♀️

@diazo def go to your solicitor, if they haven’t given u copy of your boundary they should have a copy, really they should have given u a copy as I have mine and have done for previous houses purchases. Look forward to the outcome x

Looking at this picture the back fence looks to go onto a road with a gate so would have to be theirs, and the beams go round to the left. (so guessing the likelihood is left is theirs. but it is a guess)

@diazo in that case you may be responsible for all but if it's only you and the other house on the left (looking out from your back door) then you may be both responsible or jointly for that fence on the left

The deeds for my house say boundaries/fences shared with privately owned homes is equal responsibility but if we share a boundary with council owned property it’s our responsibility

Really? That’s the first I’ve ever heard that. Why would you give your neighbours the best side of the fence? Looking at the photo I’d say it was the right side. My house we own the right hand side

Really. ? I worked in conveyancing and I have never heard that before ever. The rule of thumb is that the right hand side belongs to the neighbour depending on how you are looking at the garden. If in doubt take your deeds to the local planning office at your council - or you could try CAB (when they are open again) although I was given incorrect advise by them.

If you look at the plans for your property, along the boundary lines there will be a short line sticking out on one side from the boundary line at regular intervals. If the line is on your side of the boundary then you are responsible for the fence . This only applies to privately owned property. Otherwise ask your landlord.

Usually if the posts are on your side of the fence then the fence technically belongs to you as it's on your boundary. When it comes to upkeep and painting it's always best to communicate with your neighbours and let them know your painting your side. They normally wouldnt argue with you over your colour choice and may instill them into painting there side. If you keep it amicable you wont have problems. But some snowflakes always see this as a problem

In theory, the fence panel 'face' should be pointing into you neighbours garden so you have the 'untidy' bit your side. So in you pic the left side panels are yours. I was told this by a builder who was doing new fencing on a new housing estate. Hope it helps.

When I lived in an old property I had a problem with a hedge so I got it checked and as your at your front door everything on the right is yours, I’m in a brand new property now and both sides are shared x

If you’re sure that it isn’t on the deeds: 1. You can undertake a further search of the Registry of Deeds which holds records of unregistered land. 2. You can strike a “boundary agreement” with your neighbour(s). This will put everything down on paper, and can officially be recorded as an ongoing legal document – saving future owners the hassle of a fencing dispute. Working this out between yourselves is often the smartest move. However, it is wise to consult a legal expert and also check the extent of the agreement’s powers.

What if you have a shared alley way? I have 3 sides of a fence on my garden, only one of them I can see the fence pots but the right side ( from the house) is shared between 3 of us and the back is shared between 2 of us- so who is responsible for which bit? Ps - there is nothing on the deeds

It'll be on your land registry docs. If there is a T at the end of the boundary that'll be yr fence. If there's none you will need permission of neighbour to do anything to the fence. The saying that the fence to your right is yrs and so on is a polite myth but not true.

The information on your deeds refers to your boundary and in some cases which fence is yours, but the fence part has now become so dated it’s not always correct. It can just as easily be whoever erected/paid for the fence. Also U no longer need to place the back of your fence towards u, that is just an old fashioned common curtesy, if u pay for it u are definitely entitled to have the nice side facing you. Hope this helps

Your usually responsible for the good side so it looks like the right side is yours and the bottom is probably the house behind you and the left your neighbours. On your deeds there should be a capital T on the boundaries if it's in your garden on the fence side it's yours and obviously vice versa . Its not always the left side . We are responsibly for the right and bottom of ours .

It should show on the property information form for which of the boundaries you are responsible for. This is more reliable than @murvyn9 from Facebook

@ascot not necessarily , we have good sides on all our fences we put them up ourselves they aren’t on the border but on our own land neighbours weren’t interested in fencing on one side and other side no one had lived there for years ‍♀️ x

@manwell3 well she can still paint the inside of it but it’s not really her fence so to speak depends who put it up really as at my house I have my fence with fencing on the inside and fencing on the outside is the neighbours fence ‍♀️ she’s best speaking to council for advice about fencing etc
